SMYRNA, Ga. (AP) — Georgia's child protection agency is facing a $1 million lawsuit in the death of a malnourished 14-year-old girl who weighed 43 pounds when she died in June in Smyrna.
WSB-TV reports (http://bit.ly/1pEdZKs) that the administrator of Markea Berry's estate filed the seven-page complaint. It alleges that the Georgia Department of Family and Children Services made several missteps in its handling of the case.
In July 2012, a state official says the agency was revamping its protocols after an investigation found that Markea was severely malnourished.
Georgia Division of Family and Children Services Director Ron Scroggy said at the time that her death should never have happened.
Police arrested the girl's mother, 38-year-old Ebony Espree Berry. WSB reports that she is being held in the Cobb County Jail on a murder charge.
