Man with keys in his pocket denies DUI

James Davis Allen, 26, was arrested for driving under the influence, reckless driving, driving in violation of license restriction and having an open container early in the morning on Oct. 20. Even though he denied driving the vehicle, the keys were found in his pocket.

A Sheriff's Deputy was traveling down Honey Creek Rd when he saw a vehicle speed past him without tail lights. Following the vehicle, the deputy noticed the car run a red light at the intersection of Honey Creek and Ga. Highway 20. The vehicle then ran a stop sign at Honey Creek Rd and Club House Lane before pulling into the Trinity Baptist Church parking lot.

According to reports, when the deputy arrived at the parked car, the driver's door was open and no one was inside. While searching the woods around the parking lot, a white male emerged with his hands up stating, "I'm not the driver."
According to reports, the suspect, Allen, said he wasn't driving the vehicle, and didn't know who was. He said someone from the party was driving.

However, Allen was searched and keys were discovered in his right pocket.

Allen said there were two sets of keys, and was then asked by the deputy how he exited the vehicle if he wasn't driving since the passenger side door was locked.

According to reports, he said "was sitting in the passenger side and jumped out the driver side."

However, there was an opened case of beer in the passenger side and a styrofoam cup of beer that was undisturbed in the center console.

The 26-year old Covington man was transported to Rockdale County Jail.
