The third suspect in the GameStop armed robbery turned murder last year, Giovante Maddox, made a request last Tuesday to withdraw his guilty plea in the 2010 armed robbery of the Conyers GameStop store .
Maddox's attorney, Robert Mumford filed two motions within a week of entering a guilty plea on Sept. 16. One motion was for a withdrawal of the guilty plea, and the other was for a reduced sentence.
According to Mumford, no specific request was made as for the specific number of years on the reduction.
Currently, Maddox, of Atlanta, is serving 20 years of his 40 year sentence on armed robbery and kidnapping. If Superior Court Judge David Irwin agreed to allow Maddox to withdraw his plea, then he would go to trial under the original charges of murder, kidnapping, and several armed robbery accounts.
"The judge indicated he is going to consider a ruling," Mumford said. "I don't expect it to take long, but it probably won't be until next week."
Maddox, 28, was arrested as one of three men who robbed the GameStop in November 2010. During the robbery, a customer, Adrian Snow, 40, was shot and killed.
All three of the subjects in the robbery, entered a guilty plea. The other two were Markus Seymore, 18, who agreed to life without possibility of parole, and Tron Hill, 26, who agreed to life plus five years without possibility of parole.
