A woman trying to wake her boyfriend for work was surprised when the man came awake swinging.

According to a Covington police report, the woman told officers that a coworker of her boyfriend, 37-year-old Robert Smith, had come to pick him up for work. She went into the bedroom and attempted to wake Smith several times. The third time was the charm, and Smith came awake swinging, according to reports.

The victim told officers that Smith "was fighting her like a man," and that he struck her with his fists at least 10 times in the head, face and torso. She complained of a sore jaw but refused treatment, according to reports.

She told officers that she kicked at Smith in order to get away from him and that he then went back to bed. The victim told officers that she has five children (ages 1, 2, 4, 7 and 9) and that the two youngest were asleep and the three oldest were outside playing when the incident occurred.

Officers went into the bedroom and made contact with Smith, who was still lying in the bed. After being told several times, Smith finally sat up. The reports indicate that he smelled like alcohol when he sat up and when officers asked about the incident, he denied fighting, saying that he had been asleep.

Smith was arrested and transported to the Newton County Detention Center where he was charged with Family Violence Act battery.
