Judge overturns Ga. man's murder conviction

DECATUR, Ga. (AP) — A judge has thrown out a murder conviction for a man who has served 12 years in prison for the crime.

The Atlanta Journal-Constitution (http://bit.ly/10FVVES ) Friday reported Superior Court Judge Daniel Coursey determined new evidence in the case would likely have resulted in a different verdict in David Peralta's murder trial.

Peralta was convicted in the 2001 slaying of 22-year-old Rebecca Moore, of Norcross. Prosecutors said Peralta, who was a member of the Latin Kings gang, killed her because she criticized him in front of other gang members and threatened to tell his pregnant fiancee about their sexual relationship.

Years after the trial, two gang members told FBI agents a 16-year-old boy killed Moore and they were in the car with him when he fired the shots.
