Parents of 5-year-old who died in playground accident file lawsuit

COVINGTON, Ga. - The parents of Andrea Tyrah DeBruhl have filed a wrongful death lawsuit in Newton County Superior Court against the county’s board of education (BOE), according to a press release from the Atlanta-based Harman Law Firm.

The five-year-old died from asphyxiation after getting her head caught while playing on the monkey bars during recess at the Newton County Theme School in February 2016.

According to the press release, the court documents contend, “The playground monkey bars did not meet equipment safety standards that were established decades ago which prohibit a child’s head to become stuck.”

The release also states lawyers intend “to expose the numerous violations in internal safety rules that occurred from the Newton County Theme School staff on the day of Tyrah’s death.”

“The lawsuit has been referred to the attorneys who will be providing a response in Court in a timely manner,” BOE spokesperson Sherri Davis-Viniard said in a statement to The Covington News. “The district is constantly reviewing safety for all students including on the playground.”

According to Eric Fredrickson, of the Harman Law Firm, no court dates have been set in the case.
